LISMOA Referral Program Terms

illustrious Inc. (the "Company") establishes the following Referral Program (the "Program") with respect to "LISMOA" (the "Service") provided by the Company.
Article 1 (Purpose and Application)
The Program grants a prescribed credit when an existing user (the "referrer") introduces the Service to a third party (the "referred party") and the referred party commences a paid subscription. These Terms apply to all users participating in the Program.
Article 2 (Definitions)
1. "Credit" means a discount applied to the Service's billing amount, granted by the Company through a payment processor (such as Stripe). Credits are not a cash equivalent.
2. "Referral link" means a tracking URL issued by the Company (e.g., https://lismoa.com/?ref=xxxx).
3. "Tracking cookie" means an identifier stored in a browser upon clicking a referral link, used for attribution purposes.
4. "Attribution period" means the 30-day period following a click on a referral link.
Article 3 (Participation and Consent)
1. A user is deemed to have agreed to these Terms by agreeing to them in the management console (e.g., via checkbox) and by obtaining, sharing, or using a referral link.
2. The Company may retain records of consent, including consent timestamp, version, IP address, and similar information.
Article 4 (Benefit Details)
Upon completion of the referred party's first paid charge, both the referrer and the referred party each receive ¥2,000 worth of credit.
Article 5 (Grant Conditions and Attribution)
1. Credit is granted only upon successful first paid charge by the referred party. Free trial periods, unpaid charges, and failed charges are not eligible.
2. Attribution is based on the last-click referral link. Credit is attributed to the referrer whose referral link was clicked last within the attribution period (30 days).
3. Measurement and attribution may be impossible or inaccurate in the following cases: disabling or deleting cookies, using a different device or browser, using private browsing mode, tracking restrictions such as ITP imposed by the OS or browser, interference from ad blockers or extensions, redirect or parameter modification, and the effect of network or security settings. The Company makes reasonable efforts to measure accurately, but does not guarantee credit grants due to technical limitations.
4. The benefit is granted only once per referred party account.
5. If a refund, cancellation, chargeback, or similar event occurs, credited amounts already granted may be reversed or adjusted accordingly.
Article 6 (Use and Rollover of Credit)
1. Credit may only be used as a discount against the Service's billing amount. It cannot be converted to cash, transferred, assigned, or refunded to third parties.
2. Credit is automatically applied at billing time; any balance exceeding the billed amount rolls over to subsequent billing cycles.
3. Credit has no expiration date unless the Company separately specifies and notifies one. An expiration date may be introduced through future specification changes.
Article 7 (Forfeiture)
If a user cancels the Service, any unused credit is forfeited. Restoration after cancellation is not possible.
Article 8 (Invalidating Acts)
If the Company determines that any of the following applies, it may invalidate the grant, retention, or use of benefits and, as necessary, claw back credits, suspend use, or suspend the account.
- 1. Self-referral or registration of multiple accounts by the same individual or organization.
- 2. Fraudulent, false, or misleading representations, or inducement through illegal or inappropriate means.
- 3. Acts whose primary purpose is to obtain benefits, such as repeatedly making payments and immediately cancelling or requesting refunds.
- 4. Acts that harm the rights or reputation of the Company or third parties.
- 5. Modifying referral links, deleting or altering tracking parameters, or illegal or inappropriate redirects.
Article 9 (Disclosure Obligations)
When introducing the Service on social media, blogs, videos, or similar platforms, clearly disclose the fact that a benefit is provided (e.g., #PR, #ad, referral benefit available). Do not make exaggerated or unsubstantiated claims or false comparative representations.
Article 10 (Changes and Termination of the Program)
The Company may change, temporarily suspend, or terminate the Program and these Terms without notice. If a user uses a referral link after such changes, they are deemed to have agreed to the changes. Re-consent may be requested for material changes.
Article 11 (Disclaimer and Reservation)
1. The Company assumes no liability for failure to grant or delays in granting benefits due to communication failures, malfunctions of external services (e.g., Stripe), inability to track, or similar causes, except in cases of the Company's intent or gross negligence.
2. If fraud is suspected, the Company may temporarily withhold the grant or use of benefits pending investigation and may, as necessary, reverse or adjust them.
3. If an obvious erroneous grant is identified, the Company may reverse that grant and offset or recover the amount in future billing.
Article 12 (Handling of Personal Information)
The Company collects and uses account information, payment status, referral paths, and similar data to the extent necessary to operate the Program. For details, please refer to the Company's Privacy Policy.
Article 13 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any disputes arising between the Company and users in connection with the Program.
